COLLABORATIVE LAW

 WHAT IS IT?

Collaborative Law is a process involving both spouses and their respective attorneys in which the Court House Litigation System is bypassed. Collaborative Law replaces Court fights by the parties and attorneys agreeing in writing to opt out of the litigation process, and working together in an atmosphere of open communication and cooperation to achieve a settlement that works for all involved, including the children, if any.

BENEFITS

The Collaborative process allows people to maintain a private, confidential, respectful end to their marriage or other Family Law dispute.  The parties preserve their dignity while striving for a conclusion that works for all involved. The mind set of WIN - LOSE, is replaced with an attitude by all involved of WIN - WIN.  The use of joint and neutral experts and advisors, if necessary, replaces the adversarial use of hired guns to battle it out in court. A respectful and creative effort by the parties and their attorneys to negotiate with a view of meeting the needs of each spouse replaces the tactical bargaining with threats of “taking the other to the Court House” which is ever present with cases pending in the Court System.
